Terms and Conditions

These Terms and Conditions govern your participation in the ATE Rewards loyalty program operated by Concept Eight Pty Ltd ABN 61 078 757 614 of 13A, 663 Victoria Street, Abbotsford, Victoria 3067 (“Concept Eight”, “we”, “us”, or “our”). By registering for, or using, your ATE Rewards Account, you accept these Terms and Conditions and consent to the collection, use and disclosure of your personal information in accordance with the Concept Eight Privacy Policy.

1. Definitions

In these Terms and Conditions, unless the context requires otherwise:

“Account” means an ATE Rewards loyalty account registered in the name of a Member.

“Active Account” means an ATE Rewards Account on which the Member has recorded at least one Qualifying Transaction.

“App” means the ATE Rewards mobile application available for compatible smart phones and devices.

“Concept Eight Restaurant” means any restaurant operating under the brands Noodle Box, Wok in a Box, Pattysmiths, Acai Bros, South Seoul, Huxtaburger, Supreme Leader Korean Krispy Chicken, Bama Fried Chicken, Bokyo Fried Chicken & Rice, Double Dragon Dumplings, Plant Patty, Nature’s Wok and Dante’s Hot Chicken, or any other brand from time to time operated by Concept Eight or its related entities.

“Inactive Account” means an Account that has not recorded a Qualifying Transaction for a continuous period of thirty six (36) months.

“Member” means an individual who has registered as a member of the ATE Rewards program.

“Points” means loyalty points earned and redeemed in accordance with these Terms and Conditions.

“Qualifying Transaction” means any in restaurant, pick up, delivery or catering purchase made by the Member at a participating Concept Eight Restaurant or via the App or ATE Rewards online ordering platform, where the Member’s Account has been linked or scanned at the point of sale.

2. About ATE Rewards

  1. The ATE Rewards loyalty program (“ATE Rewards”) can be used at any Concept Eight Restaurant located within Australia.
  2. By registering for, or using, the App, you consent to these Terms and Conditions.

3. Membership

  1. To become a Member, you must:

(a) Sign up to ATE Rewards online or via the App for compatible smart phones; and

(b) Validate your membership by providing all requested information on the registration form.

  1. Concept Eight reserves the right to decline any membership application in its absolute discretion.
  2. Only one ATE Rewards Account may be activated per person.
  3. Once your membership is activated, you are eligible to earn Points in accordance with these Terms and Conditions.
  4. You may close your Account at any time by contacting Guest Relations at help@aterewards.com.au. Upon closure, any unredeemed Points, vouchers or other entitlements will be forfeited.

4. Earning Points

  1. Points will be earned at the rate of one (1) Point for every $1 spent at any Concept Eight Restaurant. For example, if you spend AUD$10.00 (including GST) at a Concept Eight Restaurant, you will earn 10 Points.
  2. All Concept Eight Restaurants accept ATE Rewards Accounts and will award and redeem Points in accordance with these Terms and Conditions.
  3. Concept Eight Restaurants reserve the right not to accept an ATE Rewards Account where they reasonably believe that its use is unauthorised, fraudulent or otherwise unlawful.
  4. From time to time, Concept Eight may offer special promotions which may include the opportunity to earn Points at a different value to that set out in clause 8. Concept Eight will allow you to choose whether you would like to participate in any such promotion and accept the adjusted Points value.
  5. Points are non transferable and cannot be redeemed for cash.
  6. Points have a 12 month expiry from the date the last Points were earned at a Concept Eight Restaurant.
  7. Only Members with an Active Account are entitled to redeem Points earned.

5. Account Inactivity, Deactivation and Deletion

  1. If a Member does not record any Qualifying Transaction on their Account for a continuous period of thirty six (36) months, the Account will be considered an Inactive Account and may be deactivated by Concept Eight in accordance with this section.
  2. Concept Eight will use reasonable efforts to notify Members at least thirty (30) days prior to deactivation, using the email address registered on the Account. Concept Eight may, in its discretion, provide additional reminders prior to that period.
  3. Where a Member has elected not to receive marketing communications, the deactivation notice will still be sent as a transactional communication regarding the status of the Account.
  4. Upon deactivation:

(a) the Account will be closed;

(b) any unredeemed Points, vouchers, credits or other entitlements held on the Account at the time of deactivation will be forfeited and may not be reinstated; and

(c) the Member will no longer be eligible for promotions, offers or rewards available exclusively to Members.

For the avoidance of doubt, all earned Points, vouchers, credits or other entitlements held on the Account will remain redeemable until the Member’s Account is deactivated.

  1. Where an Account is deactivated under this section, Concept Eight will delete the personal information associated with that Account in accordance with the Concept Eight Privacy Policy and applicable Australian privacy laws, including the Australian Privacy Principles.
  2. A limited subset of information may be retained where required for legitimate business purposes, including:

(a) compliance with any record keeping obligation under Australian law;

(b) resolution of any actual or anticipated dispute; and

(c) maintenance of a marketing suppression record, in a hashed or de identified form, to ensure that deleted Members are not inadvertently re onboarded into ATE Rewards or related marketing communications.

  1. A person whose Account has been deactivated under this section may register a new Account at any time, subject to these Terms and Conditions and any applicable promotional eligibility rules. Re registered Members will not be entitled to recover any Points, vouchers, credits or entitlements held on a previously deactivated Account.
  2. Concept Eight reserves the right, in its absolute discretion, to:

(a) vary the inactivity period from time to time, with notice to active Members in accordance with clause 38; and

(b) apply or not apply this section to any individual Account where Concept Eight reasonably considers it appropriate to do so, including in cases of medical, family or other extenuating circumstances notified to Concept Eight in writing.

  1. These provisions apply to all Accounts from the date these Terms and Conditions take effect. Should a Member’s Account be deemed as inactive as at the date these Terms and Conditions take effect, Concept Eight will provide a minimum of ninety (90) days’ notice prior to any deactivation under this section.

6. Rewards

  1. Once you have accumulated 200 Points, you will receive a $10 credit voucher in your Account for use in restaurant or online.
  2. You are entitled to a $10 voucher for your birthday. The $10 birthday voucher will expire if not redeemed within 30 days. Concept Eight takes no responsibility if you have incorrectly entered your date of birth during the sign up process.
  3. To be eligible for the birthday reward, you must have been a Member for at least 30 days.
  4. To receive the birthday reward via email, you must be subscribed to ATE Rewards marketing communications.
  5. The $10 birthday reward can only be redeemed in restaurant. You must show photo identification to redeem.
  6. If you need to change your date of birth or it has been incorrectly entered during sign up, please contact Guest Relations at help@aterewards.com.au. Date of birth can only be updated once.
  7. You may update your personal details, with the exception of your email address and date of birth, at any time by signing into your Account on the ATE Rewards website or App.

7. Catering

  1. The App allows Members to order catering from participating Concept Eight Restaurants.
  2. All catering orders must be placed through the App.
  3. Members will earn Points at the rate of one (1) Point for every $1 spent on any catering order placed through the App.
  4. Catering orders are subject to a minimum spend of $130.00. All orders may be paid by credit card, Apple Pay or Google Pay. Cash is not accepted for online orders through the App.
  5. Catering orders are for pick up from a Concept Eight Restaurant only.
  6. Catering orders must be received by the participating restaurant at least 48 hours in advance.
  7. Any changes to a catering order must be made by contacting the relevant restaurant directly using the phone number provided on the emailed tax invoice.

8. General

  1. Concept Eight, acting reasonably, may amend these Terms and Conditions at any time. Where any amendment materially affects Member rights or obligations, Concept Eight will provide at least thirty (30) days’ notice of the amendment by email to the address registered on the Account. If the amended Terms and Conditions are not acceptable to you, you have the right to cancel your ATE Rewards membership at any time by emailing help@aterewards.com.au.
  2. If any services provided by Concept Eight to you under these Terms and Conditions are within the scope of the Australian Consumer Law set out in Schedule Two of the Competition and Consumer Act 2010 (Cth) (“ACL”) then, subject to the provisions of the ACL, a number of guarantees will apply in respect of the services under the ACL including:

(a) the services being rendered with due care and skill;

(b) the services being for the purpose for which the services are being acquired, any disclosed purpose, or being capable of achieving any disclosed result; and

(c) the services being supplied within a reasonable time.

  1. Concept Eight does not offer any guarantees other than those contained in the Consumer Guarantee provisions of the ACL. To the maximum extent permissible by law, Concept Eight will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with Concept Eight’s provision of services to you under these Terms and Conditions, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  2. Information collected from you in connection with your ATE Rewards membership will be used in accordance with these Terms and Conditions and the Concept Eight Privacy Policy.
  3. If any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable, the remaining provisions will continue in full force and effect.
  4. These Terms and Conditions are governed by the laws of the State of Victoria, Australia. The parties submit to the exclusive jurisdiction of the courts of that State.
